General terms of sale

Sale of the Nicolosi Creations company General Terms herein define the rights and obligations of the parties within the framework of the sales of products by Nicolosi creations. The consumer is deemed accept without reservation all of the provisions laid down in these so-called terms.Nicolosi Creations is committed for its part to comply with its reseller role in the framework of these same terms. In addition these conditions apply to the exclusion of any other terms.

 

Article 1 : Products

The list of products displayed on our website is not exhaustive.
Products conform to the legislation applicable in France. The photographs texts, information and features reproduced and showing products presented are not contractual. Accordingly, the responsibility of Nicolosi Creations cannot be committed on error or omission in one of these protographs and texts.

Article 2 : Prices

Web site prices are quoted in euros all taxes included (TTC) but exclude postage charges.
Prices are subject to the French VAT and any change of VAT alters, whether up or down, this will be reflected in the prices of our product.
For deliveries outside of the French territory, the provisions by the General Code relating to the VAT will be applied.

Article 3 : Order

Valid in mainland France, Corsica, Monaco and in the countries witch belong to 1, 2, 3,4, 5, 6,7, and 8 (look delivery Zones).

To order some products on our Web site :
• browse the on-line catalog
• then add products to your shopping bag
• then on the cart page click on 'valid my order”
• identify yourself using the form fill.
• then choose your shipping details and payment method.

Article 4 : Payment

Payment must be made when the order is placed, before the goods are dispatched.

All orders, wherever they originate, are payable in euros. Payment in stamps or cash is not accepted.

N.B. If payment does not cover the full value of the order, only the goods paid for will be dispatched.

Online Payment by Credit Card :

You can pay for your order online using a MasterCard, a Visa credit card or an American Express. During the final stage of placing your order you must enter the number of your Credit Card and its expiry date (you must never enter your PIN number). This information is entered in encrypted sections and all information transmitted is encoded. None of this information circulates on Internet in unencrypted format.

Article 5 : Delivery

An order shall be deemed closed when all of products will have been shipped and the customer shall fully payment for products and its participation in the shipping costs acquitted.

The delivery address is the one you filled in on your order form.
Goods dispatched within International Territories are all sent by the French Post Office's Colissimo service.
Nicolosi Creations cannot be held responsible for any direct or indirect results of disruptions (strikes etc) to postal services.

International Zone 4 (Finland, Norway, Sweden et Switzerland) average of delivery time 4 – 8 business days.
International Zone 5 (Greece, Hungary, Iceland, Poland, Czech Republic, Slovakia, Slovenia, Croatia) average delivery time 4 – 8 business days.
International Zone 6 (Other countries of the Eastern Europe, Morocco, Algeria, Tunisia), average delivery time 4 – 8 business days.
International Zone 7 (United States, Canada, Africa, Middle East) average delivery time 4 – 8 business days.
International Zone 8 (Americas except United States and Canada, Asia et Oceania) average delivery time 4 – 8 business days.

N.B. These delivery times are given as an indication only and Nicolosi Creations cannot be held responsible for any delays in delivery.

Article 6 : Garantees

For an exchange or repayment, you have 7 days from delivery date to return the untouched articles in their packing of origin, with an explanatory letter. You will have to support the return costs.

Article 7 : Data protection

The sale contract is governed by French law. Any dispute regarding the interpretation or the non-fulfilment of this contract will exclusively be the concern of the Commercial Court of Digne les Bains 04000, France, only this court is of competent jurisdiction for the resolution of any dispute.

According to the act "Informatique et libertés" from 6th July 1978, you have a right of access and correction of the data concerning yourself. Through our intermediary, you may receive offers.
If you don't agree with this, you just have to write to us (letter, fax, e-mail) and indicate your name, address. Proceed this way if you don't wish to receive commercial offers anymore. In order to exercise this right, please send your mail to:
